These Terms & Conditions govern the use of this website and the booking of boat trips marketed through Algarve Yacht Charters (“we”, “us”, “our”).By submitting an enquiry or confirming a booking, you agree to these Terms.

2. Our Role as Intermediary

Algarve Yacht Charters acts solely as an intermediary/agent between clients and independent third-party boat operators.

  • We market and promote boat trips operated by licensed local companies.
  • We do not own or operate the vessels listed (unless explicitly stated).
  • The contract for the execution of the trip is between the client and the operating company.

Each operator is responsible for:

  • Vessel operation
  • Crew
  • Insurance
  • Safety compliance
  • Navigation decisions
  • Execution of the service

3. Booking Process

All bookings are made through an enquiry system.

  • A booking is not confirmed until you receive written confirmation from us.
  • Availability is subject to confirmation by the operating company.
  • Prices are subject to change until confirmed.
  • Verbal agreements are not binding unless confirmed in writing.

We reserve the right to decline any booking request.

4. Payments

Payment terms vary depending on the operating company.

  • Some services require a deposit to secure the booking.
  • Full payment deadlines will be communicated at confirmation.
  • A booking is only secured once payment is received as instructed.

Failure to pay within the agreed timeframe may result in cancellation.

5. Weather & Navigation Conditions

All boat trips are subject to:

  • Weather conditions
  • Sea state
  • Wind conditions
  • Navigation restrictions
  • Instructions from coastal or maritime authorities

Trips may be cancelled, delayed, modified, or rescheduled if:

  • The captain considers conditions unsafe
  • Coastal authorities impose restrictions
  • Access to specific areas (e.g., caves or beaches) is limited
  • Port authorities close navigation routes

The captain’s decision is final and made in the interest of safety.

6. Cancellations & Refunds

Cancellation and refund policies vary depending on the service provider.At the time of booking confirmation, we will inform you of the specific cancellation policy applicable to your selected trip.In general:

  • Weather-related cancellations may result in rescheduling or refund, depending on the operator’s policy.
  • Client cancellations may be subject to penalties.
  • No-shows are typically non-refundable.

Refund timelines and methods are determined by the operating company.Algarve Yacht Charters cannot be held responsible for differences in cancellation terms between operators.

7. Changes to Itinerary

Itineraries may be adjusted due to:

  • Weather
  • Sea conditions
  • Time constraints
  • Authority restrictions
  • Operational requirements

No compensation is due for reasonable itinerary adjustments made for safety or compliance reasons.

8. Limitation of Liability

As an intermediary:

  • We are not liable for accidents, injuries, damages, losses, or delays occurring during the execution of the trip.
  • Liability rests with the operating company providing the service.
  • We are not responsible for force majeure events including storms, governmental restrictions, or maritime closures.

9. Client Responsibilities

Clients agree to:

  • Follow crew instructions at all times
  • Respect safety rules onboard
  • Arrive on time at the designated meeting point
  • Inform us in advance of medical conditions that may affect participation

Operators reserve the right to refuse boarding to intoxicated or unsafe passengers without refund.

10. Insurance

All vessels are required to hold legally mandated insurance under Portuguese maritime law.Details of insurance coverage are managed directly by the operating company.

11. Accuracy of Information

While we aim to ensure all information is accurate:

  • Photos may be illustrative
  • Boat models may vary
  • Minor variations in service details may occur

We are not responsible for typographical errors.

12. Governing Law

These Terms are governed by Portuguese law.Any disputes shall be subject to the jurisdiction of the Portuguese courts.
